Step by step
Notice
For unpaid rent, a 5-day written notice is common. Some leases include this notice already.
Rule to Vacate or Show Cause
The landlord applies at Magistrate Court and you are served a Rule to Vacate or Show Cause. You usually have 10 days to request a hearing. If you do not, the magistrate can issue a writ of ejectment.
Hearing
At the hearing, bring your lease, receipts, photos and any messages. If you miss it, the court can rule against you.
Judgment and appeal
Appeal deadlines are very short, often 5 days. You may need to pay rent into the court to stay in the home during the appeal.
Writ of ejectment
Once a writ is issued, the constable can remove you after 24 hours.
